Effective from October 1, 2025r.
§ 1. GENERAL PROVISIONS
- These Regulations define the terms and conditions of use of access codes enabling temporary, free access to the services provided by the Miromate platform.
- The Regulations constitute an integral part of the contract for the provision of services by electronic means within the meaning of the Act of 18 July 2002 on the provision of services by electronic means.
- Acceptance of the Regulations takes place upon activation of the Access Code and is equivalent to the conclusion of a contract for the provision of services.
§ 2. DEFINITIONS
Whenever the Regulations refer to:
- Service providers- this should be understood as SPACE FOR CHANGE LIMITED LIABILITY COMPANY, Tomasza Zana 39A, 20-634 Lublin, Poland, NIP: 7123443193, REGON: 523387913, KRS: 0000996967,
- Access code- this should be understood as a unique, one-time alphanumeric string entitling to temporary, free access to the Services;
- User- this shall be understood as a natural person with full legal capacity, a natural person with limited legal capacity acting with the consent of a legal representative, a legal person or an organizational unit without legal personality to which the law grants legal capacity;
- Account- this should be understood as an individual User panel in the Miromate system, available after logging in;
- Services- this should be understood as the functionalities made available by the Miromate platform as part of the activated Access Code;
- Validity period and - this should be understood as the time during which the User can use the Services based on the activated Access Code.
§ 3. RULES FOR USING ACCESS CODES
- The access code is granted to the User under the terms specified by the Service Provider and may be used only for its intended purpose.
- Each Access Code:
- is unique and one-off,
- can only be used by one User,
- is assigned to one Account,
- has a specific Validity Period (30 or 90 calendar days).
- The User is obliged to keep the Access Code confidential and not to use it in a manner that is contrary to the law, good practice or infringes the legitimate interests of the Service Provider.
§ 4. ACTIVATION AND CODE USE
- The necessary condition for activating the Access Code is:
- creating an Account in the Miromate system,
- acceptance of these Regulations and the Privacy Policy,
- entering the Access Code in the dedicated field in the User panel.
- The Service Provider reserves the right to verify the User's identity, including by:
- email address verification,
- IP address control,
- identification of the end device,
- other mechanisms to protect against abuse.
- The access code can only be activated within the validity period indicated when it was issued.
- After the Validity Period has expired, access to the Services is automatically deactivated without the need for any additional declarations by either party.
§ 5. RESTRICTIONS AND PROHIBITIONS
- The user is prohibited from:
- making the Access Code available to third parties, whether for a fee or free of charge,
- resale of the Access Code,
- use the Access Code for commercial purposes without the prior written consent of the Service Provider,
- registering more than one Account in order to use more Access Codes,
- taking actions aimed at circumventing the technical security measures of the platform,
- using the Services in a way that may disrupt the functioning of the platform or violate the rights of other Users.
- Violation of the provisions of paragraph 1 will result in immediate blocking of the Account and invalidation of all active Access Codes without the right to compensation.
§ 6. LIABILITY
- The Service Provider is not responsible for:
- the consequences of making the Access Code available to third parties by the User,
- inability to use the Access Code due to reasons attributable to the User,
- damage resulting from the use of the Services contrary to the Regulations.
- The total liability of the Service Provider towards the User is limited to the nominal value of the Access Code, and in the case of free codes, this liability is excluded to the fullest extent permitted by law.
§ 7. PERSONAL DATA PROTECTION
- The administrator of Users' personal data is the Service Provider.
- Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (GDPR) and the Personal Data Protection Act.
- Detailed rules for the processing of personal data are specified in the Privacy Policy available on the Service Provider's website.
§ 8. COMPLAINTS
- The User has the right to submit a complaint regarding the functioning of the Access Code or the Services provided.
- Complaints should be reported:
- by e-mail to: hi@miromate.com
- in writing to the registered office address of the Service Provider.
- The complaint should include:
- data identifying the User,
- description of the subject of the complaint,
- circumstances justifying the complaint,
- User's request.
- The Service Provider will consider the complaint within 14 business days of its receipt, informing the User about the method of its consideration.
§ 9. FINAL PROVISIONS
- The Service Provider reserves the right to:
- temporary suspension of the availability of the Services for technical reasons,
- terminate the access code program at any time, while maintaining the rights acquired by Users,
- changes to these Regulations for important reasons.
- The Service Provider will inform Users about changes to the Regulations at least 14 days in advance via a message in the system or via e-mail.
- In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Act on the provision of services by electronic means.
- The parties will endeavor to resolve any disputes arising from these Terms and Conditions amicably. In the event of failure to reach an agreement, the dispute will be resolved by a court of competent jurisdiction in accordance with the provisions of the Code of Civil Procedure.
- The Regulations come into force on October 1, 2025.
